Rules of the Olivia Garden Instagram contest “Hairdresser of the Month”

This contest is organised by Olivia Garden S.A, whose office is located at Rue de Hermée, 255, 4040 Herstal, Belgium (“Olivia Garden”).
By participating in the contest, you ( the “Participant”) accept these rules and any decision of Olivia Garden on any dispute that may arise concerning the interpretation and/or application of these rules. The participation contrary to the articles of these rules will be considered invalid and will not be eligible for the Prize.
In this respect, Olivia Garden reserves the right to make all necessary checks regarding each Participant’s identity, age, contact details, and professional status. Any incomplete, erroneous, falsified information that does not allow the Participant to be identified or located will cancel his/her participation.

 

Please read the following rules carefully:

  1. Olivia Garden is organising a free contest that runs from 01st July, 2022 at 1:00 am to 28th July, 2022 at 11:59 pm (hereinafter the “Contest”) on Instagram page of the Olivia Garden S.A. (www.instagram.com/oliviagarden_eu).
  2. The contest is open to individuals with legal residence in the European Union, The United Kingdom and Switzerland, except for members of staff of Olivia Garden and any other person who contributed to organising and running the contest.
  3. Participants must be eighteen (18) years old or over and work as a professional hairdresser at the time of the participation.
  4. To enter the Contest, the Participant must do the following cumulative actions, no later than 28th July, 2022 at 11:59 pm:
    1. Follow Instagram @Oliviagarden_eu
    2. Post a photograph of your hairstyles with the monthly theme ”Braid Style” by the 28th day of each month.
    3. Insert #oliviagardenhair in the caption of the post
    4. Tag @Oliviagarden_eu on the picture posted
    5. Your profile should be public and visible to Olivia Garden.

  1. The photographs must be original and free of right. They must respect the legislation and regulations in force and in particular (non-exhaustive list) not infringe on any intellectual property right, not contain any offensive, insulting, defamatory, pornographic or discriminatory content, not infringe on image rights (any person appearing in a photo must have given his or her prior consent).
  2. There are no limit of postages by Participant. Every post/photograph following the criteria described on point 4 is eligible for the Prize.
  3. All photos will be judged by Olivia Garden personnel (the “Judges”), and one (1) Participant (the “Winner”) will win the contest. The Judges shall select a Winner using the following equally weighted criteria: creativity and the composition of the photograph. Decisions of the Judges are final and biding.
  4. The Winner will win a box with Olivia Garden tools (the “Prize”):
    1. 1 pouch with 2 scissors (a cutting scissors and a thinner),
    2. 10 brushes,
    3. 2 capes
    4. 2 sets of combs (cutting and styling combs)
    5. 2 cards of Double Clip Petite Black (4pc/cards)
    6. 2 brush cleaners
  1. The Winner will be announced on 30th July on Olivia Garden’s official Instagram account and will be contact the next working day by private message in Instagram. If the Winner does not respond within five (5) days of having contacted, he/she will be considered to have renounced the Prize, and the Prize will be reallocated to an alternate winner.
  2. The Winner will be asked to provide Olivia Garden with his/her physical address and contact details for the only purpose of arranging the delivery of the Prize. The Winner’s address and contact details will not be sold or transferred to third parties except the carrier that Olivia Garden will appoint to deliver the Prize. The personal data provided will be used in strict compliance with the rules relating to the GDPR detailed below.
  3. Participants’ data will be kept for a maximum of sixty (60) days from the date of their designation. The Winners’ data will be kept for a period of three (3) years as from the delivery of the Prize. In accordance with the law of 30th July 2018 on the protection of individuals with regard to the processing of personal data and the General Data Protection Regulation n°2016/679 of 27th May 2016 (the “GDPR”), you have the right to access, rectify, delete and – in the event of a legitimate reason – object to the processing of your personal data, as well as a right to the limitation and portability of your data under the conditions provided for in the GDPR. If you have any questions on this subject or wish to exercise your rights, you can contact the data controller by e-mail at GDPR@oliviagarden.eu Following Article 77 of the GDPR, you also have the right to complain with the Data Protection Authority if you believe your rights have not been respected (contact@apd-gba.be; +32 (0)2 274 48 00).
  4. Olivia Garden is not responsible for any delayed or not received entries due to any error, omission, Internet or software problems, or other reason beyond Olivia Garden’s control.
  5. Per Instagram rules, this promotion is in no way sponsored, administered, or associated with Instagram or Facebook.
  6. The Participant shall not make any statement considered prejudicial, threatening, illegal, defamatory, unauthorised, obscene, abusive, injurious, or inciting violence or racial, religious, ethnic hatred.
  7. Any logo, material or related intellectual property rights published by Olivia Garden belongs exclusively to Olivia Garden and may not use in any way whatsoever such logo, material or intellectual property right without Olivia Garden written consent.
  8. The present competition is subject to Belgium laws.
